Terms of Service

These terms form an agreement between you and Momentum Cloud Pty Ltd (ABN 36 145 339 037) for your use of Hitloop. By creating an account or embedding the Hitloop widget you agree to them.
1. The service
Hitloop lets you embed a widget on websites you control so that users can submit bug reports, feature requests and feedback, which are collected in your dashboard and can be forwarded to tools you connect.
2. Your account
You must provide accurate details, keep your credentials and project API keys confidential, and are responsible for all activity under your account. Tell us promptly at security@momentumcloud.com.au if you suspect unauthorised access.
3. Acceptable use
You must not:
- Embed the widget on a website you do not own or have permission to modify
- Use the service to collect payment card data, health records, government identifiers or other sensitive information
- Attempt to access another customer's projects, reports or keys
- Probe, scan, overload or circumvent rate limits or security controls
- Upload malware, or unlawful, infringing or harassing content
- Resell or provide the service to third parties except as their agent
4. Your content
You retain ownership of the reports, attachments and other content submitted to your projects. You grant us a licence to host, process and display that content solely to operate the service for you. You are responsible for notifying the users of your website that the widget collects the information described in our Privacy Policy, and for obtaining any consent required by law.
5. Third-party integrations
Optional integrations (AI rewriting, GitHub syncing, agent/MCP access) send your content to those providers when you enable them. Their terms govern their handling of that content, and we are not responsible for their services.
6. Availability and support
We aim to keep the service available but do not guarantee uninterrupted or error-free operation. We may change, suspend or discontinue features, and will give reasonable notice of material changes where practical.
7. Suspension and termination
You can stop using the service and delete your account at any time. We may suspend or terminate access if you breach these terms or if your use puts the service or others at risk. On termination we delete your data in line with the retention section of our Privacy Policy.
8. Australian Consumer Law
Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law that cannot lawfully be excluded. Where liability can be limited, our liability is limited to resupplying the service or paying the cost of resupply.
9. Liability
Subject to the section above, the service is provided "as is" and, to the extent permitted by law, we are not liable for indirect, incidental or consequential loss, loss of profits or loss of data.
10. Governing law
These terms are governed by the laws of New South Wales, Australia, and you submit to the non-exclusive jurisdiction of the courts of that place.
